Terms of Use (EULA)
These Terms of Use ("Terms") are a legal agreement between you and Peter Healy (trading as Trace) ("Trace", "we", "our", or "us") governing your use of Trace.
1. Acceptance of Terms
By accessing or using Trace, you agree to these Terms. If you do not agree, do not use the service.
2. Eligibility and Account Responsibilities
You must be legally able to enter into this agreement and provide accurate account information. You are responsible for maintaining account credentials and for activity that occurs under your account.
3. Using Trace
Trace lets you upload or share podcast screenshots from your device so we can identify a playing episode and generate text outputs such as transcripts, snippets, or exports. Results depend on screenshot quality, visible playback metadata, and the availability of downstream podcast data or audio. Not every screenshot will produce a usable result.
4. Subscription Billing Terms
Trace offers recurring subscription plans, including monthly and annual options. By purchasing a subscription:
- You authorize recurring billing through your selected app store provider.
- Your subscription auto-renews unless canceled before renewal.
- Pricing and renewal terms are shown at time of purchase.
- Subscription management and cancellation are handled through Apple App Store or Google Play account settings.
5. Trials and Promotions
If offered, trial or promotional terms will be disclosed at the time of offer and may be changed or discontinued as permitted by law.
6. Refunds
Payments are generally processed by the app store platform. Refund requests are typically governed by the policies of Apple App Store or Google Play, except where local law requires otherwise.
7. Acceptable Use
You agree not to misuse Trace, including by:
- Violating applicable law or third-party rights.
- Uploading screenshots or other content you do not have the right to share.
- Uploading screenshots that include highly sensitive or unrelated personal information about yourself or others when that information is not necessary to use the service.
- Attempting unauthorized access, interference, or disruption of the service.
- Using Trace for abuse, fraud, or harmful automated behavior.
8. User Content and Screenshot Uploads
You retain ownership of screenshots and other content you submit to Trace. You grant Trace a limited, non-exclusive right to receive, transmit, analyze, and process that content solely to operate the service, provide outputs to you, troubleshoot issues you ask us to investigate, and comply with legal obligations. You represent that you have the rights and permissions needed to upload the content and that doing so does not violate applicable law or third-party rights.
9. Intellectual Property
Trace and all related software, branding, and content are owned by Peter Healy (trading as Trace) or its licensors and are protected by applicable intellectual property laws.
10. Service Availability and Changes
We may modify, suspend, or discontinue features from time to time. We do not guarantee uninterrupted or error-free operation.
11. Disclaimer of Warranties
To the maximum extent permitted by law, Trace is provided "as is" and "as available" without warranties of any kind, express or implied.
12. Limitation of Liability
To the maximum extent permitted by law, Peter Healy (trading as Trace) will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill.
13. Governing Law
These Terms are governed by the laws of South Australia, Australia, without regard to conflict-of-law principles, except where mandatory consumer protections apply.
